Welcome to Handle Monitor, a service developed and operated by KudoMetrics LLC, located at 1309 Coffeen Avenue STE 1200, Sheridan, WY 82801, United States. Our platform helps users monitor the availability of their desired social media handles on X, Instagram, TikTok, Twitch, Facebook, and Pinterest.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and KudoMetrics LLC ("Company," "we," "us," or "our") governing your access to and use of Handle Monitor ("Service"). By creating an account, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

Handle Monitor provides users with the ability to monitor the availability of social media handles across various platforms. Our service includes:

• Free basic monitoring with standard check intervals
• Premium Plan upgrades for individual handles offering hourly availability checks
• Email notifications when monitored handles become available
• Dashboard management for tracking multiple handles

Premium Plan pricing is $7.99 per month per handle or $79.90 per year per handle. Pricing is subject to change with reasonable notice to users.

Service Availability: While we strive for 99.9% uptime, we do not guarantee uninterrupted service availability. Maintenance, updates, or technical issues may temporarily affect service access.

Account Requirements

• You must be at least 18 years old to use this Service
• You must provide accurate and complete account information
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized access to your account

Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to circumvent, disable, or interfere with security features
• Use automated tools to access the Service beyond normal usage
• Monitor handles for harassment, cybersquatting, or malicious purposes
• Resell or redistribute the Service without written permission
• Upload malicious code or attempt to hack the Service

Premium Plan Billing

• Users are billed monthly or yearly for each handle upgraded to Premium Plan
• Billing occurs on the same date each billing cycle
• Payment is due in advance for the upcoming billing period
• All fees are non-refundable except as required by applicable law

Payment Processing

• Payments are processed by third-party payment processors
• You authorize us to charge your payment method for all applicable fees
• Failed payments may result in service suspension
• You are responsible for any bank fees or transaction charges

Price Changes

We reserve the right to modify pricing with 30 days' notice to existing subscribers. Price changes will not affect your current billing cycle.

Cancellation

• You may cancel your Premium Plan subscriptions at any time through your dashboard
• Cancellations are effective at the end of the current billing period
• We recommend canceling at least 24 hours before your next billing cycle
• You will retain access to Premium features until the end of your paid period

Refund Policy

All Premium Plan fees are non-refundable. We do not provide refunds for partial months, unused service, or cancelled subscriptions, except as required by applicable consumer protection laws. In case of billing errors, please contact us within 30 days for resolution.

Service Termination

We reserve the right to suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with reasonable notice.

We respect your privacy and are committed to protecting your personal information. Our collection, use, and protection of your data is governed by our Privacy Policy, which complies with applicable US privacy laws including:

• California Consumer Privacy Act (CCPA)
• Other applicable state privacy regulations
• Federal data protection requirements

By using our Service, you consent to the collection and use of your information as described in our Privacy Policy. We do not sell, rent, or trade your personal information to third parties without your explicit consent, except as outlined in our Privacy Policy.

Handle Monitor and all its content, features, functionality, design, code, and trademarks are the exclusive intellectual property of KudoMetrics LLC and are protected by United States and international copyright, trademark, and other intellectual property laws.

License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or business purposes, subject to these Terms.

Restrictions

You may not:

• Reproduce, distribute, or create derivative works of our Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove or modify any proprietary notices or labels
• Use our trademarks or branding without written permission

User Content

You retain ownership of any content you provide to us. By using the Service, you grant us a limited license to use this content solely to provide the Service to you.

No Guarantee of Accuracy

While we strive to provide timely and accurate notifications regarding handle availability, we do not guarantee the accuracy, completeness, or timeliness of this information. Social media platforms may:

• Update their systems or policies without notice
• Experience downtime that affects handle status detection
• Implement rate limiting that impacts our monitoring capabilities
• Change their terms of service affecting handle registration

Third-Party Platforms

Our Service relies on third-party social media platforms. We are not responsible for:

• Changes to platform policies or availability
• Platform downtime or technical issues
• Platform-specific handle registration requirements
• Platform decisions regarding handle eligibility

Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

IMPORTANT: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KUDOMETRICS LLC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• Missed opportunities to claim desired handles
• Lost profits or business opportunities
• Service interruptions or delays in notifications
• Inaccurate or untimely handle availability information
• Data loss or corruption
• Third-party platform changes or restrictions

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

User Responsibility: You acknowledge that you are solely responsible for taking timely action upon receiving notifications and that we cannot guarantee your ability to successfully register any handle.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Binding Arbitration

Any disputes, claims, or controversies arising out of or relating to these Terms or the use of Handle Monitor shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

Arbitration Rules

Arbitration will be conducted under the Commercial Arbitration Rules of the American Arbitration Association (AAA). The arbitration will take place in Sheridan, Wyoming, or via video conference at the arbitrator's discretion.

Class Action Waiver

You agree that disputes will be resolved on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitrations.

Exceptions

This arbitration provision does not apply to: (a) disputes regarding intellectual property rights; (b) claims for injunctive relief; or (c) claims within the jurisdiction of small claims court.

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles. For any disputes not subject to arbitration, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Sheridan County, Wyoming.

International Users: If you are accessing the Service from outside the United States, you acknowledge that these Terms are governed by Wyoming law and any disputes will be resolved in Wyoming courts or through arbitration as specified above.

Termination by You

You may terminate your account at any time by canceling your subscriptions and deleting your account through your dashboard or by contacting us.

Termination by Us

We may suspend or terminate your account immediately, without prior notice, for:

• Violation of these Terms or our policies
• Non-payment of fees
• Fraudulent or illegal activity
• Extended periods of inactivity
• At our discretion with reasonable notice

Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may retain certain information as required by law or for legitimate business purposes. Provisions regarding limitation of liability, indemnification, and dispute resolution shall survive termination.

We reserve the right to update, modify, or replace these Terms at any time at our sole discretion. Changes may be made to:

• Comply with applicable laws or regulations
• Reflect changes in our Service or business practices
• Address security or technical issues
• Clarify existing terms or add new provisions

Notice of Changes: We will provide notice of material changes by email to your registered address or by posting a prominent notice on our website at least 30 days before the changes take effect. Minor changes may be posted without advance notice.

No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of such provision or any other provision.

Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.
